receipt and sufficiency of which are hereby acknowledged, Seller
grants, sells, conveys and transfers the
following canine (the “Canine”):

Registration and ownership transfers:
Upon payment in full as set forth above, Seller shall promptly take
all legal actions necessary to officially transfer
ownership and limited American Kennel Club (AKC)
registration, if applicable, of the Canine to
Buyer. The breeder reserves the right to affix
the kennel name “Lost Creek” and supply a registry
name for the canine.
Seller Representations:
Seller warrants to Buyer that Seller is the legal and true owner of
the Canine and that Seller has the unqualified
right to sell the Canine. Furthermore, Seller
warrants that the Canine is sold free and clear of
any lien, security interest, mortgage or other
encumbrance.
Warranties:
The Canine is sold with no express or implied warranties or
representations having been made by Seller to
Buyer other than those expressly stated above.
Additional Provisions:
1. Use of the Canine:
a. It is agreed between breeder and purchaser this canine is
being acquired as a family companion canine to be
used for tasks appropriate to its breed such as a
therapy canine or for exhibition in appropriate
AKC or United Kennel Club (UKC) events.
b. We agree the canine is not purchased for resale nor will
it be used or trained for activities which are
illegal or for which it is not suited by reason of
temperament or conformation. Specifically it
will not be used for breeding, as a guard or
attack dog or to hunt or fight other animals.
2. Spay & Neutering:
a. Females must be spayed
on or before six months of age and Males must be
neutered before two years of age. The breeder
requires receipt of a certificate of spay/neuter
from a qualified veterinarian within 14 days after
completion of the procedure.
3. Ownership Responsibilities:
a. The purchaser agrees to maintain the canine in a humane
environment and properly train and care for it.
Specifically the canine will be properly licensed
and Inoculated against rabies, distemper,
parvovirus, and other communicable diseases as
recommended by a qualified veterinarian.
b. The canine will not be allowed to roam and will be
socialized and obedience trained appropriately.
Buyer agrees that this canine is NOT to be LEFT
UNSUPERVISED LOOSE OUTSIDE, IN A CRATE, TIED OR
CHAINED TO ANYTHING AT ANY TIME WHILE
UNSUPERVISED. The breeders strongly recommend
permanent identification by tattoo or microchip.
This canine is sold with the understanding that it
is to go to carefully selected parties and that
Buyer AVOWED the canine would become a member of
the family. (This is to assure proper development
and maintenance of the temperament for which
Alaskan Malamutes are known and for which the
canine was bred.)
c. Buyer agrees to maintain contact with Seller at reasonable
periods of time to advise as to the health and
well-being of the canine. Buyer agrees, likewise,
to permit Seller access to the canine on a
periodic basis to ascertain the health and
well-being of the canine and that the terms of
this contract are being complied with.
d. Buyer agrees that Seller has the right to REPOSSESS CANINE
UPON EVIDENCE OF NEGLECT AND/OR ABUSE, which
neglect and/or abuse shall be determined solely by
Seller, at no expense to the Seller.
e. If the time comes that said canine is repossessed, Buyer
agrees to IMMEDIATELY SIGN OVER TO THE SELLER THE
CANINE’S AKC RESISTERATION PAPERS, at no expense
to Seller.
4. Right of Recovery/Placement:
a. The canine shall not be sold or resold, raffled, donated,
or given to or auctioned to any canine wholesaler
or retailer, pet store, commercial kennel/breeder,
enterprise or any persons or corporations engaged
in either the resale or wholesale trafficking of
canines, or any agent of the aforementioned. If
this part of the contract is violated in any way,
the buyer is liable to the seller for the sum of
$2000.00 per canine or dog in damages as well as
any and all costs of reacquiring all animals
involved, their medical and rehabilitation
expenses, and any and all legal fees or expenses.
b. This canine is NON-TRANSFERABLE. Should the buyer be
unwilling or unable to keep the canine for any
reason, the buyer MUST RETURN THE CANINE TO THE
SELLER AT THE BUYER’S EXPENSE.
Governing Law:
This contract can only be modified, changed, or updated if agreed
to in writing and signed by both the buyer(s) and
the seller.
This Agreement shall be governed by and construed in accordance
with the laws of the State of
Colorado.
In Witness Whereof, Seller has executed and delivered this Bill of
Sale this 22nd day of October
2007.
I have read, understood, and agree to abide by all the provisions
and terms as outlined in this contract.
